PLEASE READ THESE TERMS CAREFULLY. By accessing or using our website, purchasing a product, or otherwise using the Services, you agree to these Terms of Service.

These Terms of Service (the "Terms") govern your access to and use of the Ayurveda Sutra website, store, related information, content, features, tools, products, and services (collectively, the "Services"). The Services are operated by Ayurveda Sutra Co., LLC, doing business as Ayurveda Sutra ("Ayurveda Sutra," "we," "us," or "our").

Our store is powered by Shopify. Shopify provides the e-commerce platform that enables us to offer the Services to you, but Shopify is not the seller of our products unless expressly stated otherwise.

By using the Services, you represent that you are legally able to enter into these Terms. If you do not agree to these Terms, do not access or use the Services or purchase products from us.

1. Eligibility and Use of the Services

You must be at least the age of majority in your state, province, or territory of residence to use the Services or make a purchase. You may not use our products or Services for any unlawful or unauthorized purpose, or in a way that violates applicable laws, regulations, or these Terms.

You are responsible for ensuring that any information you provide to us, including your contact, billing, shipping, and payment information, is accurate, current, and complete.

2. Products and Product Information

We make reasonable efforts to present our products and product information accurately. However, product descriptions, images, ingredients, colors, packaging, pricing, availability, and other content may contain errors, omissions, or variations. Colors and other visual details may appear differently depending on your screen or device. Product packaging and formulation details may change from time to time, and the product label and ingredient list provided with the product should be treated as the most current source of product information.

We reserve the right to modify, discontinue, limit, or update products, product descriptions, pricing, promotions, packaging, or availability at any time without notice, subject to applicable law.

3. Cosmetic Use, Safety, and Health Information

Ayurveda Sutra products are cosmetic personal-care products. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and content available through the Services is for general informational purposes only. Nothing on the Services is medical advice or a substitute for advice, diagnosis, or treatment from a qualified healthcare professional.

Use all products only as directed on the product label. Unless expressly stated otherwise on the product label, our products are for external use only. Do not use a product on broken or irritated skin. Avoid contact with eyes. Discontinue use if irritation, discomfort, or an adverse reaction occurs, and seek medical advice when appropriate. If you are pregnant, nursing, have a medical condition, have known allergies or sensitivities, or are under the care of a healthcare professional, consult a qualified healthcare professional before using a product if you have questions about its suitability for you.

Please review product ingredients carefully before use. You are responsible for determining whether a product is suitable for you and for following all warnings and directions provided with the product.

4. Orders, Pricing, and Payment

When you submit an order, you are making an offer to purchase the selected product(s). An order is accepted only when we send you a shipment confirmation or otherwise confirm acceptance. We may refuse, cancel, or limit any order at our discretion, including due to product availability, pricing or product-description errors, suspected fraud, suspected resale, or other legitimate business reasons. If we cancel an order after payment has been captured, we will issue a refund for the amount paid for the canceled item(s), subject to applicable law.

Prices are shown in U.S. dollars unless otherwise indicated and are subject to change without notice. Applicable sales tax, shipping charges, and other charges will be shown at checkout before you complete your order. You agree to pay all charges associated with your order, including applicable taxes and shipping fees.

We use third-party payment processors, including Shopify Payments and other payment methods made available at checkout. By submitting payment information, you authorize us and our payment processors to charge the applicable payment method for your order.

5. Shipping, Returns, and Refunds

Our Shipping Policy and Refund Policy are incorporated into these Terms by reference. Please review those policies before placing an order. They explain our current order-processing, shipping, return, and refund practices.

We currently ship within the United States unless we expressly state otherwise at checkout. Delivery dates and transit times are estimates, not guarantees. We are not responsible for delays caused by carriers, weather, customs, or other events outside our reasonable control. You are responsible for providing a complete and accurate shipping address at checkout.

6. Promotions and Discount Codes

Promotions, discounts, and discount codes are subject to the specific terms communicated with the offer. Unless we state otherwise, promotions cannot be combined with other offers, are not transferable, have no cash value, and may not be applied to prior purchases. We may modify, suspend, or end a promotion at any time, subject to applicable law.

7. Personal and Non-Commercial Use; No Resale

Products purchased through the Services are intended for personal use only. You may not purchase products for resale, distribution, export, or other commercial purposes without our prior written permission. We may cancel or limit orders that appear to be placed by dealers, resellers, distributors, or other unauthorized commercial purchasers.

8. Accounts and Electronic Communications

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without authorization.

By providing your email address or other contact information, you consent to receive transactional communications from us, including order confirmations, shipping notifications, customer-service messages, and other communications relating to your account or purchases. Marketing communications are sent in accordance with your preferences and applicable law. You may opt out of promotional emails by using the unsubscribe link in the email; opting out will not stop transactional communications.

9. Reviews, Feedback, and User Content

If you submit reviews, comments, feedback, photographs, ideas, suggestions, or other content to us or through the Services (collectively, "User Content"), you represent that you have the right to submit it and that it does not violate any law or the rights of any third party.

You grant Ayurveda Sutra a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, adapt, publish, translate, distribute, display, and otherwise use User Content in connection with operating, promoting, and improving the Services and our products, subject to applicable law. You may not submit User Content that is unlawful, misleading, defamatory, threatening, infringing, invasive of privacy, obscene, or otherwise objectionable.

We may, but are not required to, monitor, edit, or remove User Content at our discretion.

10. Intellectual Property

The Services and their content, including text, graphics, photographs, product images, videos, artwork, logos, designs, trademarks, trade dress, product names, and other materials, are owned by or licensed to Ayurveda Sutra and are protected by applicable intellectual-property laws. Except for the limited right to use the Services for personal, non-commercial purposes, no content may be copied, reproduced, distributed, modified, displayed, transmitted, or otherwise exploited without our prior written permission.

11. Prohibited Conduct

You agree not to:

• Use the Services or products in violation of applicable law or these Terms.
• Interfere with, damage, disrupt, or attempt to gain unauthorized access to the Services, accounts, systems, or networks connected to the Services.
• Use automated means, including bots, scrapers, crawlers, or data-mining tools, to access or collect information from the Services without our written permission.
• Misrepresent your identity, submit false information, engage in fraud, or attempt to evade any security or order-processing measure.
• Use our content, branding, product images, or intellectual property without our prior written permission.
• Use the Services in a manner that infringes, misappropriates, or violates the rights of any other person or entity.

12. Third-Party Services and Links

The Services may include links to third-party websites, social-media platforms, payment services, or other services that we do not own or control. Your use of third-party services is subject to the third party’s terms and privacy practices. We are not responsible for third-party content, products, services, policies, or practices.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT PRODUCT INFORMATION WILL ALWAYS BE COMPLETE OR CURRENT.

Nothing in these Terms excludes or limits any warranty, condition, liability, or consumer right that cannot be excluded or limited under applicable law.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AYURVEDA SUTRA CO., LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES, PRODUCTS, OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES, PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you.

15. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Ayurveda Sutra Co., LLC, its affiliates, officers, directors, employees, agents, and suppliers from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your violation of these Terms, your misuse of the Services or products, or your violation of any law or the rights of another person or entity.

16. Governing Law and Venue

These Terms and any dispute arising out of or related to the Services, products, or these Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Subject to applicable law and any rights you may have to bring an eligible claim in small-claims court, you agree that the state and federal courts located in New York County, New York, will have exclusive jurisdiction over disputes arising out of or related to these Terms.

Nothing in this section limits or waives any consumer protection right that you may have under the mandatory laws of your place of residence.

17. Changes to These Terms

We may update these Terms from time to time for operational, legal, regulatory, or other reasons. We will post the updated Terms on the Services and revise the "Last updated" date. Changes will take effect when posted unless otherwise stated. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

18. Severability and Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other provision.
